These Terms of Service govern access to and use of KwikMenu, including the website, product application, QR menu pages, software features, templates, integrations, and related services provided by MIKOSBROS LLC.

2. Acceptance of Terms
By accessing the website, creating an account, using KwikMenu, uploading content, selecting a plan, starting a trial, or paying for a subscription, you agree to these Terms. If you use KwikMenu on behalf of a company or other organization, you represent that you have authority to bind that organization.
If you do not agree to these Terms, you must not use KwikMenu.
3. The Service
KwikMenu is a software-as-a-service platform for creating, digitizing, translating, publishing, and managing digital menus, QR menu pages, restaurant catalogues, and related content.
We may modify, update, improve, suspend, or discontinue any part of the service at any time. We may add or remove features, change interfaces, adjust limits, and update technical requirements as part of normal product operation.
4. Business Use
KwikMenu is intended for business and professional use. You are responsible for ensuring that your use of the service complies with all laws, regulations, industry rules, food labeling requirements, consumer protection rules, data protection requirements, and other obligations applicable to your business.
5. Accounts and Security
To use certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to keep it updated.
- You are responsible for all activity under your account.
- You must keep passwords, tokens, and access credentials confidential.
- You must promptly notify us if you suspect unauthorized access or compromise.
- We may suspend or restrict access if we reasonably believe an account creates security, legal, operational, or payment risk.
6. Customer Content
You retain ownership of menus, text, photos, logos, trademarks, prices, descriptions, files, and other content that you upload or submit to KwikMenu. You grant MIKOSBROS LLC a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, publish, translate, modify for formatting, and otherwise use Customer Content as necessary to provide and improve the service.
You are solely responsible for Customer Content and for ensuring that it is accurate, lawful, up to date, and does not infringe third-party rights. This includes responsibility for menu prices, allergens, ingredients, nutrition information, availability, promotional statements, photos, trademarks, and any personal information included in the content.
7. Acceptable Use
You agree not to:
- Use KwikMenu for unlawful, misleading, harmful, fraudulent, or abusive purposes.
- Upload content that infringes intellectual property, privacy, publicity, or other rights.
- Attempt to access systems, accounts, data, or features without authorization.
- Interfere with, disrupt, overload, scan, scrape, reverse engineer, or compromise the service.
- Use the service to build a competing product or copy protected elements of KwikMenu.
- Circumvent usage limits, billing restrictions, technical protections, or security controls.
- Transmit malware, spam, or content that may damage systems or users.
8. Plans, Fees, and Payment
KwikMenu may be offered through paid plans, free plans, trials, promotional access, or custom commercial arrangements. Plan features, prices, billing periods, limits, and other commercial terms are displayed on the website, in the application, in checkout, or in a separate written agreement.
Unless stated otherwise, fees are charged in advance and are non-refundable except where required by law or expressly agreed by MIKOSBROS LLC. Taxes, bank fees, currency conversion fees, chargeback fees, and similar amounts may be added or handled by payment providers.
If a subscription renews automatically, you authorize recurring charges for each renewal period until cancellation. You are responsible for maintaining valid payment information and cancelling before renewal if you do not want to continue.
9. Trials and Free Features
We may offer trials, free plans, credits, or promotional access at our discretion. We may modify, limit, or end such access at any time. Trial or free access does not guarantee future availability of any feature or price.
10. Suspension and Termination
We may suspend or terminate access to KwikMenu if you violate these Terms, fail to pay amounts due, create security or legal risk, misuse the service, infringe third-party rights, or if continued access may harm KwikMenu, users, partners, or third parties.
You may stop using KwikMenu at any time. Cancellation affects future billing periods and does not automatically entitle you to refunds for fees already paid, unless required by law or expressly stated otherwise.
11. Intellectual Property
KwikMenu, including software, interfaces, designs, templates, workflows, documentation, logos, trademarks, trade names, and other materials, is owned by MIKOSBROS LLC or its licensors and is protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use KwikMenu for your internal business purposes during the applicable subscription or access period.
12. Third-Party Services
KwikMenu may integrate with or link to third-party services such as payment providers, hosting providers, analytics tools, messengers, maps, AI tools, translation providers, or other external platforms. Your use of third-party services may be governed by their own terms and policies. We are not responsible for third-party services, content, outages, or practices.
13. AI, Automation, and Generated Output
Some KwikMenu features may use AI, automation, OCR, translation, parsing, or generation technologies. Output may contain errors or omissions. You are responsible for reviewing and approving all generated, translated, parsed, or suggested content before publishing or relying on it.
14. Disclaimers
KwikMenu is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, MIKOSBROS LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, accuracy, and availability.
We do not guarantee any particular business, marketing, financial, ranking, conversion, traffic, or operational result from using KwikMenu.
15. Limitation of Liability
To the maximum extent permitted by law, MIKOSBROS LLC and its owners, officers, employees, contractors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of revenue, loss of data, business interruption, reputational harm, or costs of substitute services.
To the maximum extent permitted by law, our total liability for any claim related to KwikMenu will not exceed the amount you paid to MIKOSBROS LLC for the service during the three months before the event giving rise to the claim, or USD 100 if you did not pay for the service.
16. Indemnification
You agree to defend, indemnify, and hold harmless MIKOSBROS LLC from and against claims, damages, liabilities, losses, costs, and expenses arising from your use of KwikMenu, Customer Content, violation of these Terms, violation of law, or infringement of third-party rights.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. Unless otherwise required by applicable law, disputes arising out of or relating to these Terms or KwikMenu will be resolved in the state or federal courts located in Wyoming, USA, and each party consents to such jurisdiction and venue.
18. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of KwikMenu after the updated Terms become effective means you accept the updated Terms.
